Standing Your Ground: A perspective on problems relating to the property next door

Lot line construction (IE developing up to a common property line with an adjoining independent and/or party wall building) requires the development property to stay inside their own meets and bounds/lot line. Any encroachment of underpinning, stability bracing, and/or roof protection is required to be resolved before the NYC Department of Buildings issues the approval for construction, as well as the building permit. The statute also requires that additional insurance be provided to the adjacent buildings in the event of unintentional collateral damage to the adjunct property and/or building(s).
About the speaker: Tim Lynch is the former Chief Engineer of the Enforcement Unit for the New York City Department of Buildings, where he focused on forensic engineering, local law/compliance inspection, concrete structures, compromised buildings, and retaining walls. He is a New York licensed professional engineer with over thirty years of structural engineering experience. In this role Tim was an incident commander for construction fatalities, construction accidents and collapses, and other building failures. He was a responder and manager for building evaluations immediately after large weather and seismic events.

- Participants will be able to identity 2022 NYC Department of Buildings Administrative Code provisions governing the development of a building and the developers and Department of Buildings obligations to not trespass and structurally damage the neighboring properties.
